Terms of sale
Conditions of sale valid for shipments to Italy. The site sells adult entertainment products. All prices are inclusive of VAT, net of transport costs and any discounts due to promotion codes. Each order is accompanied by a regular Packing List or Commercial Invoice (only if specifically requested at the time of the order in the notes section). The customer can only purchase products present in the electronic catalog of enjoythepleasure.com that can be viewed online. It is possible to place orders in the following ways.
Purchase by online order
Buying online is really easy, with just a few simple clicks. The sales contract stipulated between enjoythepleasure.com and the customer must be considered concluded with the acceptance, by the customer, of the conditions of sale by clicking Confirm Order on the purchase form. enjoythepleasure.com will send an Order Confirmation email to the customer as an order acceptance receipt. Once the online purchase procedure has been completed, the customer must print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of Legislative Decree 206/05 (consumer code).
GENERAL RETAIL SALES CONDITIONS enjoythepleasure.com
The general conditions of sale set out below concern the purchase of products and services by electronic means and are governed by Legislative Decree no. 6 September 2005 206 (Consumer Code) on distance selling with consumers, and by Legislative Decree 9 April 2003 n. 70 in the field of electronic commerce. The sales contract stipulated between the Customer and B&G COMPANY srls will be governed and interpreted in accordance with Italian law.
OWNERSHIP OF THE SITE
The enjoythepleasure.com website (hereinafter the Site) belongs to B&G COMPANY srls with registered office in Via Livenza n. 14 00015 Monterotondo, Rome – VAT number IT15659291007, and is aimed at the sale of products online via the internet on the site www.enjoythepleasure.com
A. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
1. By placing an order following the various methods provided on the Site, the Customer declares to have read all the information provided during the various mandatory and necessary steps for the purchase procedure and to fully accept the general conditions of sale and payment transcribed below as well as the specific characteristics of the product being purchased and this in order to fully satisfy the condition set out in Articles 4, 5, 52 and 53 of Legislative Decree No. 206/2005. 2. These general conditions of sale, together with the conditions regarding the methods of delivery and payment of the purchased goods, form an integral part of the sales contract concluded between the Customer and B&G COMPANY srls Therefore, B&G COMPANY srls invites you to carefully read these general conditions of sale, to print them or, in any case, to keep a copy. 3. It is strictly forbidden for the buyer to enter false or third-party data in the registration procedure necessary to activate the process for the execution of this contract. B&G COMPANY srls reserves the right to legally pursue any violation and abuse in order to protect the users themselves.
B. PURCHASE METHOD – ACCEPTANCE OF THE ORDER
1. The Customer can purchase the products on the site accessible at the address www.enjoythepleasure.com as described in the relevant information sheets. 2. When the purchase is made, the Customer has the possibility to choose the method of delivery and payment of the product he prefers. The acceptance of the order by B&G COMPANY srls is confirmed by sending an e-mail and / or an SMS to the number indicated in the relevant order and / or to the e-mail address communicated by the Customer at the time of registration on the Site. B&G COMPANY srls. reserves the right, at its sole discretion, not to fulfill the order. 3. The Customer undertakes to verify the correctness of the data in the order confirmation email and to promptly report any errors or omissions to B&G COMPANY srls. C. PRICES
All prices indicated on the site are to be understood as retail prices and, therefore, VAT INCLUDED (22%). Product prices may vary without notice and will be valid at the time of purchase.
D. PAYMENTS
The payment of the purchased products and related shipping costs must be made by the Customer at the time of the conclusion of the order, using one of the following methods:
PAYMENT BY CREDIT CARD: Visa, MasterCard, PostePay, prepaid cards always from the VISA circuit. In case of payment by credit card, the financial information (card number, expiry date, etc.) will be automatically managed by the Checkout.com Secure Server, without MSX S.r.l. or third parties may have access in any way. NB: All payments will be marked on your credit card statement with the words “M03”
PAYMENT WITH PAYPAL: Thanks to Paypal you can pay safely directly on the checkout page. Choose the Paypal method from the list of payment methods, log in with your Paypal credentials and complete your order
E. SHIPPING AND DELIVERY
The shipment of the purchased goods will respect the order in which the requests were received. The shipment and delivery, to the address indicated by the Customer in the order form, will take place by express courier throughout Italy and in the countries indicated. For purchases outside the European Union it will be necessary to pay the customs taxes that will be borne by the customer. The courier will respect, in delivering the purchased goods to the customer, standard delivery times.
F. MAJOR AGE
www.enjoythepleasure.com is an online site for the sale of products, clothing and accessories for adults. By purchasing products from B&G COMPANY srls, the Customer declares to be over 18 years of age. If the customer is not of age B&G COMPANY srls will not accept his order.
G. RIGHT OF WITHDRAWAL
Pursuant to and within the limits of art. 64 and following of Legislative Decree no. 206/2005, the consumer customer has the right to withdraw from the purchase contract, for any reason, if not satisfied. The Customer can exercise this right by communicating his / her wish to withdraw by completing the RMA form found on the enjoythepleasure.com website. This procedure will generate a code (RMA) which must be indicated together with the shipping data outside the package. The right of withdrawal may be exercised no later than 14 working days from receipt of the goods. If the RMA code is not shown on the package, the customer will not be entitled to a refund of the amount due. Upon receipt of the goods with the indication of the RMA code, B&G COMPANY srls will check the integrity of the same and will refund, net of shipping costs. Warning! The right of withdrawal does not apply to: goods made to measure or personalized;
sealed audiovisual products or software, unsealed by the consumer (eg a sealed DVD);
newspapers, magazines and periodicals;
clothing without the original packaging, as well as underwear without the original packaging and / or worn;
objects and accessories whose use involves contact with secretions and mucous membranes, if it is ascertained that they have come into contact WITH MUCOSA OR BODY LIQUIDS (for example ball gags, dildos, vibrators, etc.) or without the original packaging and / or used ;
items on offer and end of series.
In addition, the right of withdrawal cannot be exercised in the event that the item is not returned in a condition of total integrity, such as in the cases of:
lack of the original packaging (it is therefore advisable to keep the original packaging of the product at least until the expiry of the deadline for exercising the withdrawal);
absence of integral elements of the product (accessories, cables, instruction manuals, etc.);
damage to the product for reasons other than transport;
state of conservation of the product not normal.
REFUNDS
If the Customer, for any reason whatsoever, wishes to return the goods, totally or partially, he will be entitled to a refund of the price paid for the purchased product. The shipping costs and the marking rights remain the responsibility of the Customer. The refund equal to the value of the goods correctly returned, excluding shipping costs, will be made within 30 days according to the payment method chosen at the time of purchase (bank transfer, PostePay recharge, PayPal, etc.). It is specified that the commissions relating to the various payment methods will be subtracted from the total to be refunded. In the absence of shipping costs for promotional initiatives, they will still be subtracted from the total to be refunded according to the following scheme:
in case of advance payment (bank transfer, credit card, paypal, post-pay top-up) the cost charged will be € 4.90
EXCHANGE OF GOODS
The Customer, no later than 14 working days from receipt of the goods, can replace all or part of the goods purchased on the Site. The goods can be exchanged only and exclusively for the following reasons:
Defective goods (check the section below dedicated to the subject);
The article is to be replaced in size;
The item was purchased incorrectly;
You want to replace the item with other goods.
The exchange of goods can be requested by completing the RMA form found on the enjoythepleasure.com website. This procedure will generate a code (RMA) which must be indicated together with the shipping data outside the package. If the RMA code is not shown on the package, the customer will not have the right to exchange the goods. Once the goods have been received with the indication of the RMA code, B&G COMPANY srls will verify the information communicated by the customer and will ship the new goods under the conditions set out above. The return must be received at our office no later than 15 days from the communication of the desire to change the goods. B&G COMPANY srls recommends using a shipping service that allows the traceability of the package as it cannot be held responsible for the loss of the package. Used products whose original packaging is broken or damaged will not be changed. The goods returned as defective will be checked by B&G COMPANY srls staff. If the item is really defective, it will be replaced and shipped FREE OF CHARGE. In the event of a defect not found, the customer will also have to bear the shipping costs for returning the item. In all other cases (point 2, 3, 4) the SHIPPING COSTS will be CHARGED TO THE CUSTOMER. The shipment of the goods to be returned must be addressed to:

The package must contain the goods with the original packaging and complete in all its parts and must be accompanied by the RMA NUMBER INDICATED ON THE OUTSIDE OF THE PACKAGE.
H. LAW APPLICABLE TO THE CONTRACT
For anything not expressly provided and regulated in these conditions of sale, the Italian law in force on the matter is applied.
I. COMPLAINTS AND WARRANTIES
The products purchased on the Site are subject to the regulations, as applicable, referred to in Legislative Decree 2.2.2002 n. 24 (Official Gazette no. 57, 8.3.2002) on sales contracts and guarantees concerning consumer goods and, to the extent not contemplated therein, with the specific provisions on the subject by the Civil Code. Therefore, all products purchased on www.enjoythepleasure.com are covered by the seller’s two-year legal warranty provided for by the Consumer Code (Legislative Decree No. 206 of 6 September 2005). Pursuant to articles 128 to 135 of the Consumer Code, consumers have the right to obtain from the seller the free repair or replacement of products that show a lack of conformity within 24 months following the date of delivery. The defect must be reported within 2 months of discovery. This guarantee will apply to products with lack of conformity and / or malfunctions not found at the time of purchase, provided that the product itself is used correctly and with due diligence, that is, in compliance with its intended use. The aforementioned guarantee will not be applicable in case of negligence or carelessness in the use and maintenance of the product. The guarantee is personal and will therefore apply only to the original purchaser, being reserved for direct customers and not for traders, resellers, etc. All returned products will be tested and will be returned at the Customer’s expense if they do not present defects and if normal operation is found. The request will be processed only if the RMA NUMBER and the invoice contained in the original B&G COMPANY srls package are present in the returned package As required by current legislation, the maximum term for reporting transport damage to B&G COMPANY srls is 8 days. from the moment of receipt. For any clarification and any complaint, please contact Customer Service. Only consumers, or natural persons who have purchased a product for use not related to commercial, entrepreneurial or professional activity, have the right to apply the legal guarantee pursuant to the Consumer Code. Therefore, invoices bearing the VAT number of a company or a professional will not give access to the rights under the legal guarantee.
L. LIMITATIONS OF LIABILITY
B&G COMPANY srls cannot be held responsible for the loss or damage suffered by the Customer due to delays, slowdowns and interruptions of the e-commerce service or due to delays in the execution of the purchase order or due to the non-execution of the same, if the delay, slowdown, interruption and non-fulfillment are caused by an impediment beyond one’s control, which could not reasonably have been foreseen and the consequences of which could not be avoided or limited.
M. CHANGES TO THE GENERAL CONDITIONS OF SALE

N. PRIVACY

NB: by submitting the order and / or requests for information, tacit consent is given to the processing of personal data according to Legislative Decree 196 of 30.06.03.
O. JURISDICTION
Without prejudice to the application of the mandatory provisions of the law established to protect the consumer, any dispute in any case connected to these general conditions of contract is devolved to the exclusive competence of the Court of Tivoli.
